The U.S. Supreme Court ruled this month that Meta had to respond to a petition regarding its infamous COVID-19 censorship collusion with the previous administration.

Meta CEO Mark Zuckerberg admitted that his company responded to pressure from the Biden administration and ultimately censored free speech, even satire, related to COVID-19. Its confession of collusion must be followed by accountability and with the help of the Supreme Court, and Children’s Health Defense (CHD) is seeking to do just that. This comes after Meta announced it would make free speech reforms and overhaul many of its censorship and fact-checking policies.

CHD, which Health and Human Services Secretary Robert F. Kennedy Jr. founded and previously chaired, aims to make Meta restore its Facebook and Instagram accounts and face consequences for its unconstitutional censorship during the height of the COVID-19 lockdowns. The organization petitioned the U.S. Supreme Court to hear its case against the platform and on March 5 the the group announced that the Court ordered Meta to file a reply to CHD’s petition by March 31. 

CHD General Counsel Kim Mack Rosenberg celebrated the Supreme Court ruling. “That the U.S. Supreme Court has now required Meta to respond seems a hopeful sign that the court is taking our petition seriously and that we also will get a chance to respond to Meta’s submission,” she declared.

CHD CEO Mary Holland enthusiastically agreed, telling the organization’s news outlet The Defender, “We see this as a good sign.” She added, “[w]hen we asked the Supreme Court to hear our case, Meta declined to file a reply, even though it had the right to do so. This latest move by the Supreme Court may delay the court’s final decision on whether it will hear our case, but it also suggests the court has questions that it believes Meta should address.”

Originally, CHD filed its lawsuit back in 2020, but the lawsuit is still ongoing. CHD was deplatformed on Facebook and Instagram back in 2022 and has yet to be restored. 

According to the organization, Meta also censored posts that included data on COVID-19 treatments and government responses such as “COVID-19 vaccines, remdesivir, and ventilation,” also the “benefits of natural immunity and alternative treatment with ivermectin and other protocols.”
