Sen. Eric Schmitt (R-MO) urged Republicans to continue to use the court system to counter leftist policies, drawing on his success in cases like Missouri v. Biden, which exposed the Biden administration's censorship agenda.

In a Fox News Sunday interview, Schmitt discussed his new book, The Last Line of Defense: How to Beat the Left in Court, and called on Americans to “stand up and fight” for their values, including free speech, using common sense legal strategies against the left. 

The show’s host Shannon Bream said, “In your book, you talk about using the legal system to effectuate policy changes and the left has been doing that with some success, at least in the short-term with regard to Trump administration policies in Trump 2.0.” 

Schmitt swiftly replied, “[T]he left has been in that court system fighting for a long time; it's time for us to stand up and have the courage to fight back and if we do that, we can win because we have the law and common sense on our side,” said Schmitt.

Earlier in the conversation, Schmitt noted, “In Missouri v. Biden, we brought the censorship case that exposed this vast censorship enterprise where the Biden administration was working with Big Tech behemoths to silence conservatives.” 

Indeed, the Missouri v. Biden lawsuit, later renamed Murthy v. Missouri, began uncovering the tangled thicket of President Joe Biden’s censorship policies. MRC Free Speech America would later expose no less than 57 censorship initiatives enacted by the Biden administration.

The MRC report reads: 

“As this report has detailed, the Biden censorship initiatives were vast, varied and spanned dozens upon dozens of government bureaus and agencies. The Murthy v. Missouri litigation alone provided 162 pages of formal documentation of censorship across four separate government departments (Commerce, Health & Human Services, Justice and Homeland Security. [Emphasis added.]  

“Despite the mountains of efforts of pervasive, illegal censorship throughout the  government, Merrick Garland’s Department of Justice did not just refuse to prosecute any perpetrators, it refused to even launch a single investigation into federal government  censorship, prosecutorial resource waste, unconstitutional action or direct work with foreign governments to censor Americans.”
