Podcaster and now California gubernatorial candidate Steve Hilton is emphasizing the current California administration’s threat to free speech with a dangerous piece of legislation.

Hilton warned on X Sept. 30, “California Democrats want to FINE and BAN you over speech they dislike in a bill hitting Newsom’s desk.” He brought The Morning Answer host Jennifer Horn on his podcast, The Steve Hilton Show, to discuss the threat of SB771, which is set to receive Gov. Gavin Newsom’s signature.

The bill would incentivize Big Tech companies to censor users by holding them liable if they amplify certain types of content through their algorithms.  The bill’s official summary notes that it is illegal to use discrimination, “violence or intimidation to interfere with another person’s enjoyment of certain rights,” and doing so would result in “certain civil penalties” or “misdemeanors.” Therefore, the lawmakers argue, if a platform allows content that could be considered intimidating, racist, or sexist, it could be liable for “aid[ing], abet[ing], act[ing] in concert with, or conspir[ing] in violation of those laws.”

On Hilton’s show, Horn warned about this bill. “Gavin Newsom and the Democrats in California love free speech until they don’t,” she said. “This is a [state] Senate bill created by Henry Stern, who is a Democrat from Los Angeles, and in this bill, they want to ban people based on what they post on social media.” Hilton agreed on X that the bill would “enable MASS CENSORSHIP.”

Horn further noted that Google recently blamed the Biden administration for pressuring it to censor Americans, a confession that Meta and Twitter (now X) already made years ago. Horn described censorship as “grossly unpopular” and “a large part of why Trump got elected.” She compared California’s new legislation to the aggressive free speech crackdown in the U.K., where numerous citizens are even arrested for online posts.
